Terms of Service

1. Acceptance of these Terms

These Terms of Service (“Terms”) form a binding agreement between you and Hole In 1 Nation (“we”, “us”, or “our”) governing access to and use of our marketing websites, golfer play applications, course and operations portals, and related services (collectively, the “Services”).

By accessing or using the Services, creating an account, scanning a contest QR code, purchasing an entry, or submitting a claim, you agree to these Terms, our Privacy Policy, Cookie Notice, Accessibility Statement, and the applicable Contest Rules. If you do not agree, do not use the Services.

These documents are provisional platform drafts pending counsel review. They do not constitute legal advice and may be updated before production launch.

2. Eligibility

You must be at least the age of majority in your place of residence (and at least 18) to create an account or purchase contest entries. Contests may impose additional age, residency, or handicap restrictions published at entry.

The Services are intended for participants in the United States and Canada. Local law may prohibit or limit skill contests or prize offerings in your jurisdiction. You are responsible for complying with applicable law where you play.

Employees, contractors, and immediate family of Hole In 1 Nation, participating courses, verification vendors, or prize insurers may be excluded from some contests as stated in Contest Rules or course supplements.

3. Accounts and accuracy

You must provide accurate contact information and keep it current for receipts, verification, claims, and payouts. You are responsible for activity under your account credentials and devices used to access the Services.

We may suspend or terminate accounts that we reasonably believe are fraudulent, abusive, ineligible, or in breach of these Terms or Contest Rules.

4. Description of Services

Hole In 1 Nation provides digital infrastructure for on-course hole-in-one and closest-to-pin contests, including QR entry, payment facilitation, leaderboards, camera-assisted verification workflows, clip review status, wallet credits where offered, and prize claim tooling.

Participating courses operate independently. Pace of play, course closures, weather holds, and local golf rules remain under course control. We do not guarantee that any contest hole will be available on any given day.

5. Entries, payments, and receipts

Contest entries must be purchased before the designated tee shot according to the Contest Rules and any course-specific instructions shown at checkout.

Prices and prize amounts are shown in the currency of the course country (USD for United States courses; CAD for Canadian courses). Taxes, if any, are handled as described at checkout and in Contest Rules.

Wallet credits, if available, apply only in the matching currency and only to eligible entries. Refunds follow Contest Rules and payment-partner policies. Keep your receipt number for support and disputes.

6. Verification and results

Official results depend on contest rules, footage availability, and review decisions. Closest-to-pin standings and hole-in-one outcomes may be delayed, corrected, or reversed if evidence is incomplete, inconclusive, or later found to violate rules.

Leaderboard freshness indicators are informational. Do not rely on provisional standings for financial decisions beyond the contest itself.

7. Intellectual property and user content

The Services, branding, software, and documentation are owned by Hole In 1 Nation or its licensors. You receive a limited, revocable, non-exclusive license to use the Services for their intended purpose.

If you submit feedback, support messages, or claim materials, you grant us a license to use them to operate and improve the Services, subject to the Privacy Policy.

8. Prohibited conduct

You agree not to:

• Interfere with cameras, QR signage, payment flows, or other golfers’ play
• Attempt to falsify distance, timing, identity, or footage associated with an entry
• Scrape, reverse engineer, or overload the Services except as allowed by law
• Use the Services for unlawful gambling where contests are restricted as skill contests
• Harass staff, reviewers, or other users through the Services

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted access, error-free verification, or that every shot will produce usable footage.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOLE IN 1 NATION AND ITS AFFILIATES, COURSE PARTNERS, AND VENDORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR ENTRIES IN THE THREE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED US DOLLARS (OR CAD EQUIVALENT), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

11. Indemnity

You will defend and indemnify Hole In 1 Nation and its affiliates against claims arising from your misuse of the Services, breach of these Terms or Contest Rules, or violation of law, except to the extent caused by our gross negligence or willful misconduct.

12. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules, except where mandatory consumer protections in your province or U.S. state require otherwise.

Courts in Toronto, Ontario will have exclusive jurisdiction for disputes arising from these Terms, subject to mandatory consumer venue rules. Contest-specific prize disputes follow the Contest Rules dispute process first.

13. Changes

We may update these Terms by posting a revised version with a new “Last updated” date. Material changes affecting active entries will be communicated through the Services where practical. Continued use after the effective date constitutes acceptance of the updated Terms.
